Terms of Service

Last updated: November 4, 2026

This is a translation of our German terms (Nutzungsbedingungen). In case of doubt, the German version prevails.

1. Scope and provider

These terms apply to the use of Stark Social, a social media cockpit operated by Daniel Lassak under the name “Stark mit Daniel”, Montfortstr. 6, 88515 Langenenslingen, Germany(hereinafter “provider”). Deviating terms of the customer only apply if the provider expressly agrees to them in text form.

2. Businesses only

Stark Social is aimed exclusively at businesses within the meaning of Section 14 of the German Civil Code (BGB), i.e. small businesses and freelancers who use the cockpit for their commercial or independent professional activity. The provider does not enter into contracts with consumers.

3. Conclusion of contract

Access is available on request by email to mail@starkmitdaniel.de. The provider then prepares an individual offer. The contract is concluded when the customer accepts this offer in text form. The presentation on the website is not yet a binding offer.

4. Services

Stark Social currently includes:

  • connecting a Facebook Page and an Instagram professional account via Meta’s Graph API, and a TikTok account via TikTok’s Login Kit and Display API,
  • insights: statistics, trends and a table of posts,
  • reports for a week, a month or a freely chosen period as HTML, PDF and Markdown, by email on request,
  • optionally an AI assessment in the reports, labeled as AI-generated. It is an aid for interpretation, not advice; the customer reviews it before using it.

Publishing posts is currently not part of the services. The exact scope results from the offer. The provider may further develop the cockpit as long as the agreed core functions are preserved.

5. Separate instance and access

Every customer receives a separate instance with its own container, its own database, its own subdomain and its own password. The customer keeps the password secret, only shares it with people working for them and informs the provider without delay if they suspect misuse. The customer is responsible for actions carried out with their access.

6. Customer obligations

  • The customer only connects accounts they are entitled to use and holds the necessary rights to the accounts and content.
  • They comply with the terms of the connected platforms, in particular TikTok’s Terms of Service and Meta’s platform terms and terms of use.
  • They do not use the cockpit unlawfully or in a way that disrupts or endangers its operation.
  • If they process personal data of third parties, they ensure they have a legal basis for doing so.

7. Third-party platforms and interfaces

The cockpit uses the official interfaces of TikTok and Meta. These providers can change, restrict or discontinue their interfaces, permissions, metrics and terms at any time. The provider has no influence on this. If functions are lost as a result, or if the platforms deliver figures late, inaccurately or not at all, this is not a defect in the provider’s service. The provider adapts the cockpit within a reasonable time, as far as this is technically and economically possible.

8. Availability and maintenance

The provider strives for operation that is as free of disruption as possible but does not guarantee any particular availability. Maintenance is announced in advance where possible. Outages for which the provider is not responsible, such as disruptions at the data center or at the platforms, are not at the provider’s expense.

9. Data protection and data processing

For the data the customer processes in their instance, the customer is the controller and the provider is the processor. The parties conclude a data processing agreement under Art. 28 GDPR for this (template). Otherwise the privacy policy applies.

10. Fees

Fees result from the offer. Unless the offer states otherwise, invoices are due without deduction within 14 days of receipt.

11. Term and termination

Term and notice periods result from the offer. If nothing is agreed there, the contract runs for an indefinite period, and either party can terminate it with 30 days’ notice to the end of a month. The right to terminate for good cause remains unaffected. Notices of termination must be given in text form.

12. Data at the end of the contract

On request, the provider makes the customer’s reports available as an export before the contract ends. Within 30 days after the end of the contract, the provider deletes the instance with all its data. Backup copies are overwritten after a further 14 days at the latest.

13. Liability

  • The provider is liable without limitation for intent and gross negligence, for injury to life, body or health and under the German Product Liability Act.
  • In the case of slight negligence, the provider is only liable if it breaches an essential contractual obligation, i.e. an obligation whose fulfillment makes the proper performance of the contract possible in the first place and on whose compliance the customer may regularly rely. In this case, liability is limited to the foreseeable damage typical for the contract.
  • Otherwise, liability is excluded.
  • These rules also apply to the provider’s vicarious agents.

14. Changes to these terms

The provider may change these terms with effect for the future, for example if the legal situation or the platforms’ interfaces change. Changes are announced in text form at least 30 days in advance. If the customer does not object before they take effect, the new terms apply; the provider points out this consequence in the announcement. If the customer objects, either party can terminate the contract as of the date the change takes effect.

15. Final provisions

  • The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
  • If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is the provider’s place of business.
  • Should any provision be invalid, the remaining provisions remain valid.
